מדיניות ביטולים, החזרות והחלפות - NakedEarth

מדיניות זו מוסדרת בהתאם להוראות חוק הגנת הצרכן, התשמ"א–1981 (להלן: "החוק") ותקנות הגנת הצרכן (ביטול עסקה), התשע"א–2010. המדיניות חלה על רכישות באתר Nakedearth.co.il המופעל ע"י פינלן קפיטל השקעות בע"מ (ח.פ. 514581941).

1. ביטול עסקה על ידי הלקוח

פרק הזמן לביטול: ניתן לבטל עסקה מיום עשיית העסקה ועד 14 ימים ממועד קבלת המוצר, או ממועד קבלת מסמך הגילוי, לפי המאוחר מבניהם.
אוכלוסיות מיוחדות: לקוח שהוא אדם עם מוגבלות, אזרח ותיק או עולה חדש, רשאי לבטל עסקה בתוך 4 חודשים מיום עשייתה או מקבלת המוצר, ובלבד שההתקשרות כללה שיחה (כולל צ'אט/מייל). החברה רשאית לבקש תעודה המוכיחה זאת.
דרכי ביטול: ניתן להודיע על ביטול באחת הדרכים הבאות:
- בדוא"ל: Info@Nakedearth.co.il
- בטלפון/וואטסאפ: 052-9030-440
- דרך טופס "צור קשר" באתר.
- בדואר רשום לכתובת החברה (בתיאום מראש).

2. תנאי החזרת מוצרים

החזרת מוצר תתאפשר בתנאי שלא נעשה בו שימוש והוא לא נפגם.
פתיחת האריזה המקורית כשלעצמה לא תיחשב כשימוש, אולם החזרת מוצר באריזתו המקורית מסייעת בזיהוי ושמירה על המוצר.
סייגים לביטול: לא ניתן לבטל עסקה עבור:
- מוצרים שיוצרו במיוחד עבור הצרכן (התאמה אישית).
- טובין פסידים (מוצרים שערכם יאבד עד החזרתם).

3. דמי ביטול והחזר כספי

ביטול עקב חרטה: ינוכו דמי ביטול בשיעור של 5% ממחיר העסקה או 100 ש"ח, לפי הנמוך מבניהם. במידה והעסקה בוצעה בכרטיס אשראי, ייתכן ניכוי נוסף של עמלת סליקה.
עלויות שילוח: במקרה של ביטול מרצון, עלות השילוח חזרה למחסני החברה תחול על הלקוח. דמי משלוח מקוריים (אם שולמו) לא יוחזרו.
מועד ההחזר: ההחזר יבוצע תוך 14 ימים מקבלת הודעת הביטול, ובאותו אמצעי תשלום, בכפוף להחזרת המוצר.

4. ביטול עקב פגם או אי-התאמה

במידה והמוצר הגיע פגום או שונה ממה שהוזמן, הלקוח לא יחויב בדמי ביטול או בדמי משלוח חוזר. הלקוח יקבל את מלוא כספו חזרה או מוצר חלופי לבחירתו. יש לדווח על פגם עם קבלת המוצר ולצרף תיעוד (צילום).

5. החלפות

ניתן להחליף מוצר במוצר אחר בתוך 14 ימים מקבלתו, בתנאי שלא נעשה בו שימוש. החלפה באמצעות שליח כרוכה בעלות דמי משלוח.

6. ביטול עסקה על ידי החברה

החברה שומרת לעצמה את הזכות לבטל עסקה במקרה של טעות חריגה במחיר/תיאור המוצר, אזל המלאי, או חשש להונאה. במקרה כזה הלקוח יזוכה במלוא סכום העסקה.

This policy is governed by the Israeli Consumer Protection Law, 1981, and the Consumer Protection Regulations (Cancellation of Transaction), 2010. It applies to all purchases made on Nakedearth.co.il, operated by Finlan Capital Investments Ltd. (Company No. 514581941).

1. Order Cancellation by the Customer

Standard Cancellation Period: You may cancel your purchase from the date of the transaction until 14 days after receiving the product or the disclosure document (whichever is later).
Special Populations (Amendment 47): Customers who are persons with disabilities, senior citizens (65+), or new immigrants (Olim Hadashim) are entitled to cancel a transaction within 4 months of the transaction date or receipt of the product, provided the transaction involved a conversation (including email, chat, or phone) between the customer and the company. The company reserves the right to request official documentation to verify eligibility.

2. Return Conditions

To be eligible for a return, the product must be unused and undamaged.
Opening the original packaging is permitted and does not disqualify the return, provided the item remains in brand-new condition. However, returning the item in its original box/packaging is highly recommended to protect the product during transit.
Non-Returnable Items:
- Custom-made or personalized products.
- Perishable goods.

3. Cancellation Fees and Refunds

Change of Mind: For cancellations not due to a defect, the Company may charge a cancellation fee of 5% of the transaction amount or 100 NIS, whichever is lower. If the transaction was made via credit card, additional clearing fees may apply.
Shipping Costs: In the case of a voluntary return (change of mind), the cost of return shipping to the Company's warehouse shall be borne by the customer. Original shipping fees (if any) are non-refundable.
Refund Processing: Refunds will be issued within 14 days of receiving the cancellation notice, using the original payment method, subject to the return of the product in proper condition.

4. Defective or Non-Conforming Products

If the product received is defective, damaged, or does not match its description on the website:

The customer will not be charged any cancellation or return shipping fees.
The customer may choose between a full refund (including shipping) or a replacement product at no extra cost.
Please report any defects upon receipt and provide visual documentation (photos/video) for verification.

5. Exchanges

You may exchange an item for a different product within 14 days of receipt, provided it is unused. Exchanges via courier will incur a standard shipping fee.

6. Order Cancellation by the Company

The Company reserves the right to cancel an order in cases of exceptional pricing or description errors, out-of-stock items, or suspicion of fraud. In such cases, the customer will be notified, and a full refund will be issued promptly.
